• You affirm that all content you upload or share on SQWAFFLE is entirely human-made and not generated by AI.
• You grant SQWAFFLE a non-exclusive, royalty-free license to display and promote your content on the site.
• You agree not to upload content that is illegal, infringing, offensive, or otherwise harmful and breach anything on our Prohibited and Restricted Items List.
• You must not upload, post, or share any content that is false, misleading, or misrepresents your identity, qualifications, or the origin of your work.
• Sqwaffle listings must not offer prizes, rewards or financial gain.

4. Intellectual Property

All content provided by SQWAFFLE, including the site design, logo, text, and original artwork (excluding User Content), is our intellectual property and protected by copyright laws. You may not use, reproduce, or distribute our content without permission.

5. Purchases and Payments

• All prices and fees are listed in the currency of your territory and are subject to change.
• Payments are securely processed by third-party payment providers.
• Payout Schedule: Payouts are processed on Fridays for all cleared funds. During beta, settlement timing may depend on payment processor clearance. Earnings for each SQWAFFLE are processed after the live SQWAFFLE has ended and paid out on the next scheduled payout, every Friday at 12:00 noon GMT.
• All sales are final unless otherwise stated (see Refund Policy).

You are responsible for any applicable taxes or duties.

6. Prohibited Conduct

You agree not to:

• Use the site for any unlawful purpose.
• Attempt to access restricted areas or interfere with site operations.
• Post harmful, fraudulent, or misleading content.
• Infringe upon the intellectual property or rights of others.
• Offer prizes, rewards or financial gain through Sqwaffle listings.
• Breach anything on our Prohibited and Restricted Items List.

7. Reporting, Moderation, and Enforcement

Users may report content or accounts that breach these Terms. Reports are reviewed through automated and manual moderation systems.

Where clear breaches are detected, the reported content or account may be hidden, restricted, or auto-blocked pending review.

False, malicious, or abusive reporting is prohibited and may result in suspension or termination of the reporting user's account. SQWAFFLE reserves the right to make final moderation determinations in its sole discretion.

Our site may contain links to third-party websites. We are not responsible for the content, policies, or practices of these external sites.

9. Safety, Wellbeing, and Legal Compliance

Content promoting, encouraging, or depicting self-harm or suicide is strictly prohibited. Such content will be removed promptly, and accounts posting it may be restricted or terminated.

Before uploading your SQWAFFLE offering, please ensure it meets our content criteria and complies with all applicable laws and regulations.

All SQWAFFLE offerings must follow these guidelines. Content that violates them will be removed without exception.

Repeated or serious violations may result in suspension or permanent removal of your account.

Prohibited Items

1. Hate Speech and Discrimination - Content that promotes hatred, discrimination or glorifies violence or terrorism is strictly prohibited.
2. Promotion of Exploitation - Any content depicting or promoting child sexual abuse, exploitation, non-consensual sexual content, or extreme violence is strictly prohibited and may be reported to authorities.
3. Personal Information - Sharing another person's private or identifying information without permission is prohibited.
4. Offensive or Obscene Material - Content that is excessively explicit, illegal, pornographic or intended purely to shock or offend is prohibited.
5. Plagiarised or AI-Generated Content - Content must be original, human-made and copyright-owned by you.
6. Copyright Infringement - Uploading work you do not own is prohibited.
7. Trademark Infringement - Using someone else's logo, brand or trademark without permission is prohibited unless protected by fair use.
8. Gambling, Lotteries and Prize Promotions - Sqwaffle must not be used for raffles, gambling, prize draws, lotteries or financial incentive schemes.

Artistic Nudity

SQWAFFLE fully supports the representation of the human form in art. Nudity shown in a purely artistic, educational, or culturally significant context is allowed, provided it does not breach other rules. Such work must be flagged as Adult/Mature Content during upload.

Potentially Infringing Items

1. Intellectual Property of Others - Counterfeits, replicas, or unauthorized use of others' work is not allowed.
2. Bootleg and Unauthorized Recordings - Live or recorded performances shared without permission are prohibited.
3. Items Enabling Illegal Activity - Content that facilitates infringement or unlawful behaviour is prohibited.

SQWAFFLE respects the intellectual property rights of artists and creators.

We comply with the Digital Millennium Copyright Act ("DMCA") and expect users of our site to do the same.

1. Reporting Copyright Infringement

If you believe that content on SQWAFFLE infringes your copyright, your DMCA takedown notice must include:

Because digital files cannot be "returned," we do not offer refunds, exchanges, or cancellations for any reason - including where a buyer does not download the content.

Downloads and Support

• Each Fan purchase includes up to three (3) download attempts per item.
• Please ensure your device, browser, and internet connection are stable before starting a download.
• If a download fails or becomes corrupted, contact support@sqwaffle.com within 7 days of purchase.

Content Removal and Compliance

If content is later removed for violating our Terms of Use, Content Policy, or applicable law, Fans retain any files already downloaded.

Refunds will not be issued under these circumstances. SQWAFFLE reserves the right to suspend or remove content, withhold payouts, or reverse sales if required to comply with legal, regulatory, or ethical obligations, or to maintain the integrity of the platform.
